All business conducted by Sprint Couriers (Pty) Ltd is subject to the following terms and conditions and those displayed in all Sprint Couriers’ office reception areas. By purchasing Sprint Couriers’ services, you agree, on behalf of yourself and anyone else with an interest in the shipment, that these terms apply once Sprint Couriers accepts the shipment. “Goods” refer to any documents, parcels, or freight accepted for carriage under a single waybill, transported by any means Sprint Couriers chooses. If you require greater protection, Shipment Insurance can be arranged at an extra cost.
A. If the Shipper is not the owner of the goods it transacts with Sprint Couriers, it warrants authorization from the owner and indemnifies Sprint Couriers against any claims from the owner.
B. Shipper agrees that its Shipment is suitable for transportation and is unacceptable if it contains hazardous material, lacks required customs declaration, or Sprint Couriers deems it unsafe or unlawful to carry, including items like animals, firearms, and unlawful drugs.
C. Sprint Couriers reserves the right to decline goods for carriage without explanation and is not considered a public or common carrier. Additionally, Sprint Couriers may inspect shipments without prior notice, and only those deemed satisfactory will be transported, with a security stamp affixed. The Shipper guarantees that the Goods comply with government regulations.
D. If the Shipment’s value exceeds the liability limits stated in Section I, Sprint Couriers can arrange Shipment Insurance upon request and payment by the Shipper, covering the actual cash value against loss or physical damage. However, this insurance doesn’t extend to indirect loss, damage, or delays. Without declaring a value for carriage and paying the requisite charge, the Shipper bears all risks beyond Sprint Couriers’ stated liability limit in Section I.
E. Sprint Couriers’ charges are based on the higher of dead/actual weight or volumetric weight, and they reserve the right to re-weigh or re-measure any shipment to ensure accurate calculation.
F. Sprint Couriers can revise their charges without prior notice and any changes to their tariff are immediately applicable to the shipper.
G. Shipments are directed to the receivers’ address specified by the shipper, excluding Post Office boxes or Postal Codes. If delivery is refused or cannot be completed, Sprint Couriers will make reasonable attempts to return the shipment to the shipper at the shipper’s expense; otherwise, Sprint Couriers may sell the shipment to cover incurred costs. Additionally, parcels not collected within 7 days will incur a daily storage fee as per the tariff.
H. Sprint Couriers doesn’t handle customs formalities or associated costs, but may voluntarily assist the Shipper by completing documents, paying duties, acting as a forwarding agent, or redirecting shipments. However, any such assistance is solely at the Shipper’s risk and expense, and the Shipper must indemnify Sprint Couriers for any incurred damages or claims.
I. Sprint Couriers’ liability is strictly limited to direct loss and the per kg limits specified. If the Shipper considers these limits inadequate, it must declare a special value and request Shipment Insurance or arrange its own insurance. All other types of loss or damage, including lost profits and future business, are excluded. Sprint Couriers’ liability for each shipment is capped at its actual cash value, with specific limits depending on the shipment’s destination and applicable laws. Passports, visas, and similar items are transported at the Shipper’s own risk.
J. Sprint Couriers aims to deliver shipments according to their regular schedules but doesn’t guarantee them and delays are not their liability.
K. The shipper is responsible for any unreasonable detention of Sprint Couriers’ vehicles or equipment caused by them, but Sprint Couriers retains its rights against others, particularly for false declarations of shipment contents.
L. Only one claim per shipment is accepted, settling all associated loss or damage conclusively. Claims must be in writing and submitted to Sprint Couriers within fifteen (15) days of shipment acceptance; failure to do so absolves Sprint Couriers of liability. Original packaging and contents must be retained for inspection until the claim is resolved, and Sprint Couriers reserves the right to withhold action until all transportation charges are paid.
M. Sprint Couriers is not responsible for losses beyond their control, including natural disasters like earthquakes or storms, as well as events such as war or labour strikes or actions by individuals not affiliated with Sprint Couriers, like the shipper or customs officials.
N. For air shipments involving countries other than the origin, the Warsaw Convention typically governs, limiting Sprint Couriers’ liability for loss or damage in most cases.
O. The Shipper guarantees that: i. the goods are accurately described and the air waybill is completed correctly; ii. the goods are properly packed for safe delivery; iii. all carriage laws are complied with; iv. the goods comply with government regulations; and v. the waybill is signed by an authorized representative, making the Terms and Conditions binding.
P. The Shipper agrees to Sprint Couriers’ sole discretion in determining the route for the shipment, which may include intermediate stopping places deemed suitable by Sprint Couriers.
Q. Any dispute related to these Terms and Conditions is subject to the non-exclusive jurisdiction of the courts in the shipment’s country of origin and governed by its laws.
R. No variations of these conditions shall be binding on Sprint Couriers unless recorded in writing and accepted by Sprint Couriers in writing.
S. Also subject to the standard trading conditions of the South African Shipping and Forwarding Agents Association, available upon request.
T. Cancelled transactions, whether the shipment has reached the final destination or not, will incur a cancellation/return fee as per the tariff. This fee applies even before the parcel moves from the origin, including transportation fees for returning the parcel or changing its destination, with a new waybill created.
U. This represents the entire agreement between the parties
